Upswell Campaign Toolkit
Terms of Service
Last updated 13 October 2026
These terms are the agreement between you and Upswell LLC for using the Upswell Campaign Toolkit at toolkit.upswell.app. By signing in, you accept them. If you use the Toolkit for an organization, you also accept them on its behalf and confirm you’re allowed to.
The short version
- The Toolkit is free and invite-only while we hone it, and it will keep changing.
- Your campaigns belong to your organization. You let us store and process them to run the Toolkit and to improve it, as the Privacy Policy describes.
- Everything the Toolkit writes is an AI draft. Check it before you use it, especially health facts.
- Don’t use it to mislead people, break the law, or upload personal information about the people you serve.
- We provide it as it is, and our liability is limited.
1. Who can use the Toolkit
- The Toolkit is invite-only while we hone it. You need to be at least 18 and using it for your work.
- Keep your sign-in to yourself. You’re responsible for what happens under your account, so tell us straight away if you think someone else has used it.
- Organization admins decide who joins their organization and can remove members. When someone leaves, their work stays with the organization.
2. Your content
“Your content” means what you and your teammates put into the Toolkit, and the drafts it writes for your campaigns. Between you and Upswell, your organization owns it.
- You give Upswell a free, non-exclusive, worldwide permission to store, copy, process and display your content to run the Toolkit for you. That includes sending it to the service providers our Privacy Policy lists, such as Anthropic for writing drafts.
- You also give Upswell permission to use what it learns from your content, including your edits and feedback, to improve the Toolkit for everyone who uses it, as the Privacy Policy describes. For lessons and examples already drawn from your work, that permission continues after you stop using the Toolkit.
- You confirm you have the right to put your content in the Toolkit, including the documents you upload and the details of any field workers you add to Coach.
- If you send us ideas or suggestions about the Toolkit, we can use them without owing you anything.
3. AI drafts need your judgment
- The Toolkit uses AI to write drafts. A draft can be wrong, out of date, or wrong for your audience, and the same request can come back different each time.
- Review every draft before you use it. Check health facts, figures, costs and service details with the health authority or program responsible for them. Nothing the Toolkit writes is medical, legal or regulatory advice.
- You’re responsible for what you publish, and for following the laws, health regulations and advertising platform rules wherever your campaign runs.
- The Toolkit helps you plan. It can’t promise results, and the reach and performance figures it shows come from the platforms and may be incomplete.
4. What you can't do
Don’t use the Toolkit to:
- break the law, or help anyone else break it;
- spread false or misleading health information, or run a campaign that deceives the people it reaches;
- harass people or discriminate against them;
- upload personal information about individual patients, clients or community members, or anything you don’t have the right to share;
- get into accounts, organizations or data that aren’t yours, or test the Toolkit’s security without our written permission;
- copy, scrape or resell the Toolkit, or use it to build a competing product;
- overload the Toolkit or interfere with how it works, including with automated scripts.
We can suspend access that breaks these rules (see “Ending” below).
6. Pulse and other services
Pulse shows figures from ad platforms such as Meta and Google Ads. Those platforms’ own terms cover your ad accounts, and we aren’t responsible for their data or whether they’re available. Make sure your organization is allowed to share the figures from any account it asks us to connect.
7. The Toolkit itself
Apart from your content, everything in the Toolkit belongs to Upswell or to the people who licensed it to us: the software, design, prompts, rules, examples, guides and case studies. These terms let you use the Toolkit. They don’t give you any other rights to it.
8. Cost, changes and availability
- The Toolkit is free. If we ever charge for it, we’ll tell you well before and you can decide.
- We’re still honing it, so features will change and some will go. We’ll try to tell you before removing something you rely on.
- We don’t promise the Toolkit will always be available or free of errors. Export anything you need to keep.
9. Ending
- You can stop using the Toolkit at any time and ask us to delete your account (see the Privacy Policy).
- We can suspend or end your access if you break these terms, or if your use puts other users or Upswell at risk. Unless it’s urgent or the law prevents it, we’ll tell you first and give you a chance to put it right.
- If we shut the Toolkit down, we’ll give you notice and time to export your work.
- The parts of these terms that by their nature should outlast your use, such as the permission for lessons already drawn from your work, the limits on liability and the governing law, continue after it ends.
10. Warranty and liability
The Toolkit is provided “as is” and “as available”. As far as the law allows, Upswell makes no promises about it beyond those in these terms, including any implied promise that it is accurate, uninterrupted or fit for a particular purpose.
As far as the law allows, Upswell isn’t liable for indirect or consequential losses from your use of the Toolkit, such as lost data, lost funding or harm to your reputation, and our total liability to you for any claim about the Toolkit is limited to US$100. Nothing in these terms limits liability that the law doesn’t allow to be limited.
11. Law and disputes
These terms are governed by the laws of the State of Washington, USA. If we disagree, we’ll first try to settle it by talking. If that fails, the state or federal courts in King County, Washington will decide it, unless the law where you are requires otherwise.
If any part of these terms can’t be enforced, the rest still applies. These terms and the Privacy Policy are the whole agreement between us about the Toolkit. If your organization has signed a separate agreement with Upswell, that agreement takes priority where the two differ.
12. Changes to these terms
When we change these terms, we’ll update the date at the top. If a change matters, we’ll tell you by email or in the Toolkit before it takes effect, and the new terms apply if you keep using the Toolkit after that. Questions go to info@teamupswell.com.
